The Law of Sealing and Expungement

Whether your charges involved DUI, a misdemeanor or felony, a juvenile crime, or domestic violence, there are some things you should know about sealing and expungement:

  • We can have your record expunged only if you received a not guilty verdict, or if the charges are dropped as result of either a diversion program or a successful motion to suppress evidence.
  • We can fight to have your record sealed by successfully entering a plea for a withhold of adjudication. Adjudication cannot be sealed or expunged, only with this withhold of adjudication can your record be sealed.
  • Sealing is only available for certain crimes, not including sexual offenses.
  • You are only allowed one sealing and one expungement in Florida.
